3.1 Order Placement

By placing an order through our website, you are making an offer to purchase products from Belsogno Beds. All orders are subject to our acceptance.

3.2 Order Acceptance

A legally binding contract is formed only when we issue a written order confirmation accepting your order. We reserve the right to refuse or decline any order before acceptance for any lawful reason.

3.3 Bespoke and Made-to-Order Products

Many of our products are bespoke, custom-made, or manufactured to customer specifications. Customers are responsible for ensuring that all dimensions, measurements, fabric selections, colour choices, and other specifications supplied at the time of order are accurate.

Once production has commenced, bespoke and made-to-order products cannot be cancelled, returned, exchanged, or refunded except where required by applicable law or where the product is faulty, damaged, or materially different from the agreed specification.

3.4 Amendments to Orders

Requests to amend an order after acceptance may be accepted at our sole discretion and may result in additional charges, revised specifications, or extended delivery times.

3.5 Cancellation by Belsogno Beds

In exceptional circumstances, Belsogno Beds reserves the right to cancel an order, including after acceptance, where fulfilment is prevented, delayed, or rendered commercially impracticable due to circumstances beyond our reasonable control.

Such circumstances may include, but are not limited to:

(a) unexpected stock shortages;

(b) supplier failures or discontinuation of materials;

(d) substantial damage to goods before delivery;

(e) transportation losses or damage;

(f) pricing, specification, technical, administrative, or website errors;

(g) force majeure events, including natural disasters, fire, flood, war, terrorism, industrial action, pandemic, epidemic, governmental restrictions, utility failures, or other events beyond our reasonable control.

Where we cancel an order, we will notify the customer as soon as reasonably practicable by email and provide a full refund of all monies paid using the original payment method.

Where reasonably possible, we may offer the customer the opportunity to place a replacement order or agree revised delivery arrangements. Any replacement order shall constitute a new contract.

3.6 Customer Rights

Nothing in these Terms excludes or limits any statutory rights available to consumers under applicable consumer protection legislation.

SECTION 5 – SHIPPING AND DELIVERY

5.1 Delivery Estimates

All delivery dates and delivery times provided by Belsogno Beds are estimates only and are not guaranteed unless expressly agreed in writing.

5.2 Delivery Delays

We shall not be liable for delays resulting from circumstances beyond our reasonable control, including carrier delays, customs inspections, adverse weather conditions, supply chain disruptions, force majeure events, or other unforeseen circumstances.

5.3 Delivery Requirements

Customers are responsible for ensuring that the delivery address is accurate and that reasonable access is available for delivery. Any additional costs arising from failed delivery attempts due to customer error may be charged to the customer.

5.4 Risk and Ownership

Ownership of goods shall pass to the customer only upon full payment.

Risk in the goods shall pass to the customer when the goods are delivered into the customer's physical possession or the possession of a person identified by the customer to receive the goods.

5.5 Inspection of Goods

Customers should inspect all products upon delivery and notify us of any visible damage, shortages, or defects within a reasonable period after receipt.

SECTION 15 – DISCLAIMER OF WARRANTIES

Nothing in these Terms excludes, restricts, or limits any rights that cannot lawfully be excluded under applicable law.

Except as expressly stated and to the maximum extent permitted by law, the Services and products are provided on an "as is" and "as available" basis without additional warranties of any kind.

SECTION 16 – LIMITATION OF LIABILITY

Nothing in these Terms shall exclude or limit liability for:

(a) death or personal injury caused by negligence;

(b) fraud or fraudulent misrepresentation;

(d) any other liability that cannot be excluded or limited under applicable law.

Subject to the above, Belsogno Beds shall not be liable for any indirect, incidental, special, punitive, or consequential losses, including loss of profit, loss of business opportunity, loss of goodwill, or loss of anticipated savings.

Our total liability arising out of or in connection with any order shall not exceed the total amount paid by the customer for the relevant order.

SECTION 21 – GOVERNING LAW

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales.

If you are a consumer resident outside England and Wales, you may also have mandatory consumer protection rights under the laws of your country of residence, and nothing in these Terms shall affect those rights.

The courts of England and Wales shall have non-exclusive jurisdiction over any dispute arising from these Terms or any contract formed under them.
